We’ve finalized our legal memo and litigation strategy to carve out h**p vapes from the SB2024 ban. AHAA is working with THBC now to enact this strategy. More to come.

At the same time, VTA has just filed their lawsuit and asked for a TRO to pause implementation — we should have updates on their filing and effect of our legal next steps early next week.

Even if the ban moves forward without challenge, here’s what to expect: Sept 1 triggers the rulemaking phase, not instant enforcement. Agencies will draft rules, take comments, and finalize — *meaning real enforcement is likely 60–90 days out*, based on past Texas timelines. Nothing is guaranteed, but that’s the most realistic outlook right now.

AHAA and brands stepping up to help are going to fight like hell to carve h**p vapes out of SB 2024.

This bill is riddled with flaws, and our legal arguments are strong and will be heard. Public-facing PR statements are coming soon — we ask everyone to echo the message and help rattle the cage so we can stop the criminalization of the h**p industry.
