Germany is expected to introduce a bill to legalize cannabis under sweeping reforms in a few weeks; which if passed, would greenlight the consumption and sale of cannabis in Europe’s largest economy. The bill could be announced by the end of March or in early April. Cannabis would no longer be classified as a narcotic, and citizens 18+ could carry up to 30 g for personal use. Consumers could grow up to three plants at home, and licensed retailers would be able to sell cannabis products. If approved, the bill could be implemented in phases between now and mid-2024, making Germany the world’s largest regulated national cannabis market and the first country in the EU to permit its commercial sale — with potentially sweeping implications for Europe. Appx. 4 million people in Germany used cannabis in 2021. It is estimated that legalizing could create 27,000 new jobs and bring in an additional 4.7 billion euros ($5 billion USD) a year in tax revenues, social security contributions, and criminal prosecution savings. Medical cannabis has been allowed in Germany since 2016.

A Kansas Senate Federal and State Affairs Committee held the first of two scheduled hearings this week on a medical cannabis legalization bill. Polling shows majority support for the reform in Kansas. Another hearing will take place in the panel tomorrow, with opponents set to testify. The legislation could potentially be taken up for a vote on Friday. In 2021, a medical cannabis bill passed the House but stalled out in the Senate. The committee also recently introduced a separate medical cannabis legalization bill. It’s not clear if or when members might take up that proposal.

Voters in Oklahoma have rejected a bill to legalize recreational use cannabis. State Question 820 sought to impose an excise tax on cannabis sales and to expunge cannabis-related criminal convictions, effectively decriminalizing cannabis. Supporters of the measure spent $5MM, outspending their opponents 20:1. The proposal was widely opposed by law enforcement, school administrators, and political and faith leaders. About 10% of the adult population has a medical license, but the program has been plagued by illegal growers, crime, and out-of-state consumers. Voters approved medical cannabis five years ago in Oklahoma. Last November, similar cannabis bills were approved in Maryland and Missouri, but defeated in Arkansas, North Dakota and South Dakota.

New York, New Jersey and Connecticut could surpass the West Coast in sales and revenue over the next decade. The creation of new jobs would be a boon for NYC, which has lagged behind the rest of the country in recovering employment lost during the pandemic. Nationally, the legal cannabis workforce has tripled over the last five years, even though the sector remains illegal under federal law, tightly regulated and forced to compete with the illicit market. The pace of job growth has already surpassed tech at its peak.

Tennessee will for now remain one of the few states with no legal medical cannabis. A state Senate committee rejected a Republican-sponsored medical cannabis bill this week (6-3 vote). There are only 11 states currently without a full-fledged medical cannabis program. A second medical cannabis bill, sponsored by Dem. Rep. Jesse Chism, is due before a Senate subcommittee soon but with how the committee voted this week most believe medical cannabis is dead for the year in Tennessee.

Democrats in the Iowa House of Representatives have introduced legislation to legalize recreational cannabis for adults. If passed, it would legalize possession of up to 500 mg of THC for adults 21+ with valid ID and would set the stage for regulated sales and establishing tax. The bill also eliminates criminal penalties for possessing up to 0.5 oz. of cannabis, reclassifying such as a civil penalty, also reducing other possession charges to misdemeanors, and expunging records of nonviolent possession convictions. The Iowa Alcoholic Beverage Division would be tasked with regulating said industry, with a requirement to implement a seed-to-sale tracking system to monitor products and prevent diversion to the illicit market. The plan sets a 10% tax, with revenue dedicated to schools, mental health services and local public safety agencies. Counties would be permitted to levy an additional 1% tax. Supporters hope this will keep cannabis tax revenue in Iowa, instead of sending it to neighboring states such as Illinois and Michigan. The bill has not been formally introduced in the House yet.

Senate Bill 5123 has passed the Washington state Senate on a 28-21 vote this week, and awaits passing the House. If it becomes law, WA employers will be prohibited from refusing to hire a worker solely based on a positive cannabis use drug test. WA would join several other states that have enacted laws shielding workers from penalties for off-duty cannabis use. However, WA’s bill only covers drug tests before hiring — an employer could still test an employee for cannabis use after hiring, and could still make a hiring decision based on a drug test that doesn’t include cannabis. Certain jobs are excluded from the bill, including those in the airline and aerospace industries, and those requiring a federal background investigation or security clearance. Recreational cannabis use was approved in WA in 2012.

Twitter has become the first social media platform to allow cannabis companies to market their brands and products in the U.S. The company earlier only allowed advertising for h**p-derived CBD topical products, while other social media platforms such as Facebook, Instagram and TikTok follow a "no cannabis advertising policy" as cannabis remains illegal at the federal level. Twitter said it will permit cannabis companies to advertise, as long as they have the proper licenses, pass through its approval process, only target jurisdictions where they are licensed to operate, and do not target people below 21 years old.

Multiple cannabis laws have been proposed in the Tennessee General Assembly this session, most focused on decriminalizing cannabis. One such, the Tennessee Medical Cannabis Act, is seeking to legalize medical cannabis. The bill would allow for medical cardholders to possess 2.5 oz., not including cannabis products, and products cannot contain more than 2,000 mg of THC. Some cardholders would be allowed to have 6 cannabis plants on their property. The bill calls on Tennessee to follow in the footsteps of 37 other states (and D.C., Guam, and Puerto Rico) which have removed state-level criminal penalties for medical use.

Wholesale cannabis platform LeafLink has secured $100MM in its latest funding round and company president Artie Minson will now serve as chief executive, while co-founder Ryan Smith will transition to executive chairman. With funding led by CPMG, L2 Ventures, Nosara Capital and others, LeafLink has secured $231MM in financing after six rounds. LeafLink is a B2B platform that helps cannabis distributors and retailers manage operations, including shipping and accepting payments. Some form of cannabis use has been legalized in 37 states, plus D.C., Guam, and Puerto Rico, but it remains illegal under federal law. LeafLink currently processes approx. $5B in annual transactions, representing an estimated 50% of legal U.S. wholesale cannabis commerce.

A bill to legalize cannabis in Minnesota was approved in its 4th House committee and advanced through its Senate committee yesterday. Lawmakers are working quickly to pass the legislation that was introduced earlier this month. Sen. Lindsey Port (D), one of the sponsors of the bill, stated that their main goals are to legalize, regulate and expunge. With majorities in both the House and Senate and control over the governorship this session, Democratic-Farmer-Labor party officials are confident that legalization will be enacted soon following the extensive committee consideration.

The FDA has released its finalized guidance on developing cannabis-based drugs, outlining the process and considerations for scientists regarding h**p and cannabis, as published in the Federal Register yesterday. Part of the reason for the guidance is the federal legalization of h**p in the 2018 Farm Bill, which makes the drug development protocol different for h**p than for ma*****na, which remains a Schedule I drug. The FDA made several non-binding recommendations for researchers, as the advice is “intended to address the legal definitions and regulatory controls related to cannabis, and to address certain questions raised about drugs containing cannabis.” As a general rule, cannabis containing no more than 0.3 percent THC by dry weight meets the federal definition of h**p and is not considered a controlled substance.
