💡 Do you know how to work with data in digital contracts?

In light of the upcoming webinar with David Tollen here are 10 key issues to consider when addressing data in IT contracts based on David's article for Tech Contracts Academy®.

✔ The type of deal is important to consider, as cloud services generally involve the provider holding customer data, making data terms important for customers.

✔ Nondisclosure agreements (NDAs) or confidentiality terms should not be used to protect data, as those clauses are designed for confidential documents and trade secrets, not for the data at issue in IT deals.

✔ Contrary to common belief, data cannot be owned in any meaningful way. Instead, focus on contract terms about data rights.
