The July 4 deadline came and went. Congress didn't act.

The BUILD America 250 Act hasn't reached the House floor. The Senate's three key committees — Environment and Public Works, Commerce, and Banking — have not released their own bill text. September 30, when the IIJA expires, is now less than 90 days away.

Here's what every bulk material producer needs to understand: this is a pattern, not a crisis. Every major surface transportation law since 2005 has expired before Congress passed its replacement. SAFETEA, MAP-21, the FAST Act — all expired first. Each time, Congress passed a short-term extension and kept programs running while negotiations continued. The IIJA will be no different.

But extensions aren't neutral. Under a continuing resolution, new project lettings slow, state DOTs defer discretionary spending, and the pipeline of new work for 2027 thins while Congress works through conference negotiations. After a 14-hour markup session on May 21–22, the House Transportation and Infrastructure Committee approved the BUILD America 250 Act by one of the most bipartisan votes in recent memory. The $580 billion, five-year highway reauthorization bill now heads to the full House floor — with a vote expected as early as June.

On May 17, the House Transportation and Infrastructure Committee released the BUILD America 250 Act: a bipartisan, five-year, $580 billion surface transportation reauthorization bill. The committee markup is set for May 21, and this legislation will replace the IIJA when it expires September 30, 2026.

Here's what bulk material producers need to know:

Of the $580 billion total, only $474.4 billion is guaranteed Highway Trust Fund contract authority — the rest is subject to annual appropriations. Bridges get the largest federal investment in U.S. history at $50B+, growing to $9 billion per year. Highway funding is up 8% in guaranteed money. And for the first time since 1993, there's a new revenue stream flowing into the Highway Trust Fund via a federal $130/year EV registration fee.
