Hiring employees in Peru? Maternity leave compliance should be part of your workforce planning from day one.

In Peru, maternity leave is a statutory right that provides both job protection and income security through the social security system.

Employees are generally entitled to 98 calendar days of maternity leave, split between prenatal and postnatal leave, with maternity pay handled through EsSalud.

For employers, this does not mean there are no responsibilities.

Companies must ensure employees are properly registered, social security contributions are accurate and continuous, documentation is managed correctly, and the employee’s role is protected during leave.

Key employer considerations include:

→ 98 calendar days of statutory maternity leave

→ EsSalud registration and contribution compliance

→ Job protection during pregnancy and maternity leave

→ Right to return to the same or equivalent role

→ Payroll accuracy to support maternity benefit eligibility

→ Additional family-related leave, including paternity leave and breastfeeding breaks

While employers may not directly pay maternity leave wages, mistakes in payroll or social security compliance can create legal risks, denied benefits, and potential penalties.
