ICT firm registered under Part B of the Companies an Allied Matters Act, CAP C20, Laws of the Federation of Nigeria, 2004. These terms of use therefore constitutes an agreement between you and KCG TECHXPLORE (referred to as The Firm). You acknowledge that you have read this Agreement and agreed to all its terms and conditions. By using the Website or our Services you agree to be bound by this Agreement. 1.0 WORK DAYS
The Firm’s work days are Mondays through Saturdays. Orders placed and sealed on a Sunday are queued to be attended to, the following day.
2.0 TERMS ON ORDERS
Orders are guided by the following terms:
2.1 ORDER PLACEMENT
The Firm is always open to receive orders from clients. For an order to be marked "valid" by the firm and queued for processing, the client(s) placing the order(s) must seal same by making a "successful payment" of at least 50% of the total worth of the job.
2.2 ORDER PROCESSING
The firm attaches no special preference/treatment to sealed orders. It is therefore important to note that orders are processed and executed on a ‘FIRST COME, FIRST SERVE’ basis.
2.3 ORDER CANCELLATION
After sealing an order, the firm allows her client(s) placing the order(s) 45 minutes to opt for cancelation and/or refund if need be. Clients who wish to cancel their sealed orders are to do so within the set time as such will not be obtainable after this time. Also, upon refund which results from order cancelation, clients will get 80% of the total amount of money paid as the remaining 20% goes to KCG TECHXPLORE as a charge for using the Firm's service space. Consequently, clients should note that the firm commences processing of their orders after the elapsing of 45 minutes from the time the order was placed.
2.4 DELIVERY
The Firm delivers orders/contents to clients within the shortest possible time. Where it is practically impossible to deliver within the agreed time, the client will be given due notice. It is important to note that clients who sealed their orders with incomplete payment will have to complete their payment immediately after job completion and just before the content is delivered.
2.5 ORDER REACTIVATION:
Clients are entitled to reactivate their orders, however, subject to the terms set out below:
After delivery, a client is spared 24 hours to review the content delivered and opt for changes if need be. Outside this time, any client opting for such services will have to pay for an order reactivation; a cost charge of $6 as inconvenience fee before the changes will be effected. However, the correction(s) to be made on the work/content will be done without charges for the first time within the 24 hours of content review. It is therefore worthy of note that any client opting for changes/corrections a second time within the review period automatically attracts to him/herself same inconvenience fee. Also, clients who seal their orders with incomplete information are spared 48 hours to provide all pending information for their jobs to be executed as they would also pay same fee at the elapsing of 48 hours.
3.0 PAYMENT POLICIES
The following terms guide payment for orders:
3.1 PAYMENT METHODS
The acceptable methods of payment by the firm are;
Mobile transfer and/or
Direct Cash Deposit. PayPal (for clients outside Nigeria)
3.2 NO FREE JOBS! Clients, partners and referees should kindly note that all services offered by the Firm are value-driven and as such must be paid for. The above notwithstanding, the firm offers promos/discounts on its services at intervals and clients can take advantage of these offers when announced.
4.0 CURRENCIES:
The Firm accepts Naira ( #) and Dollar ($). Clients who therefore wish to carry out any business transaction(s) with the firm using any other foreign currency must pay the price equivalent in either of the two accepted currencies.
5.0 FILE HANDLING
The Firm does not send her source files to her clients or any other third party for any reason whatsoever. This is in a bid to avoid/combat piracy of this brand. Clients requesting for the source files of their jobs handled at and by the firm will have to pay for them so that the firm's seal is formally and legally withdrawn.
6.0 COPYRIGHT / TRADEMARKS
The Client guarantees that any element of text or graphic furnished to the firm for inclusion in the content do not infringe on any existing copyright or trademarks that have been owned by another company or organization. To this end, KCG TECHXPOLORE will not be a party to any claim or suit arising from the use of such information which is furnished by the client. The firm puts in efforts to present legally distinct and original work. If by coincidence, the firm’s work for the client accidentally infringes on any existing trademarked design, the firm’s liability is limited to revisions to the content(s) so as to make it legally distinct, or the provision of a new content, at the client's discretion. It is the Client's responsibility to ensure that the name of their product, company or service is not already in use, and it is also the Client's responsibility to secure a service mark or trademark to protect the rights to any name or content.
7.0 LICENSING
Any content created for the client by the firm is licensed for use by the client, upon full payment and may not be modified, re-used, or re-distributed in any way or form without the express written consent of the Firm.
8.0 CONFIDENTIALITY
The firm will not share any proprietary information, trade secret or other confidential information shared by the client for the purpose of completing jobs. The firm will not use any of this proprietary information for their personal benefit at any time.
9.0 REFERRAL
Referrals attract 30% of the total profit realized from any order or all the orders placed by the referred client(s) the first time; immediately after a successful sealing of the order(s). Referees should therefore note that the referral bonus is only paid once upon the first order(s) placed by the client as subsequent orders placed by same client(s) would attract no referral bonus/bonuses.
10.0 PARTNERSHIP:
We are open to partner with other legal establishments/bodies.
11.0 ADVERTISEMENTS:
The Firm is up and open to help her clients, intending clients and other business owners (including start-ups) build their brands and advertise them to the world through Sponsored Ads. Clients opting for this service on the firm's website or any of the social media platforms would have to choose either to pay daily, weekly, monthly or yearly, depending on the duration of the advert. Most importantly, it is worthy of note that this service is anchored on a ‘PAY BEFORE SERVICE’ basis.
12.0 LIMITATION OF LIABILITY
The firm shall not be liable for any failure or delay in supply or delivery of services where such failure or delay is wholly or partly due to any circumstances outside the reasonable control of the firm. Such circumstances include but not limited to fire, flood, computer failure, Illness, injury, or other events beyond the firm’s control.
13.0 DISPUTE RESOLUTION
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Nigeria. Any dispute related to these terms or our services shall be resolved by Alternative Dispute Resolution, particularly by Negotiation.
14.0 CHANGES AND AMENDMENTS
The firm reserves the right to modify these outlined terms from time to time. However, the firm will make a new copy of these terms available on the official website while any newly added terms will be communicated to clients. You understand and agree that if you use the Services after the date on which the Terms have changed, KCG TECHXPLORE will treat your use as acceptance of the updated Terms. CONTACTING US
