Globally, the Alternative Disputes Resolution (ADR) mechanisms continue gaining huge momentum and mandatory acceptance as the first point of resolving disputes.

According to the United Kingdom's Civil Justice Council’s report, a report commissioned by the Master of Rolls -Sir Geoffrey Vos on compulsory alternative dispute resolution, mandatory ADR is lawful and should be encouraged.

In Kenya, we have 'The Alternative Dispute Resolution Bill, 2021' which proposes a raft of radical shifts in the field of ADR. The Bill continues getting a mixture of huge support and vehement opposition from different justice players.

One of the highly contested parts of the Bill is Part V from section 31-36 which summarily provides a duty of the Advocates to advise their clients on the need to use ADR, failure to which the advocate is liable for an offence punishable by a fine of not more than five hundred thousand shillings (Kshs 500,000).

Significantly, Part V makes it mandatory to first try the ADR system before approaching the court. A litigant will be required to file in court a certificate signifying that the ADR was considered before commencing the judicial proceedings.

We will continue watching out the progress of the ADR Bill, 2021 and how various factions support their stand. However, what is certain is that ADR is a force to reckon in the justice sector and a pragmatic shift to the traditional disputes resolution.

Kateryna Yeroshenko is the Ukrainian Legal Aid Foundation, Program Coordinator / Legal Empowerment Practical Program, Coordinator.

Kateryna’s professional interests: advocacy, community social work, ensuring access to legal aid in the community, development of community leadership, community and police cooperation, monitoring of law enforcement activities.

Since 2014, she has been coordinating projects and programs at the All-Ukrainian Charitable Organization “Ukrainian Legal Aid Foundation”. In particular, she coordinates paralegals’ monitoring and assessment, the activities in the field of implementation of international standards of human rights in police activities, development of networks of free legal aid providers in communities, advocacy of the right to legal aid.

She was presenting during the ADR Week on the role of the Ukrainian Access to Justice School of Practice - a program that seeks to support platforms and inventors promoting accessible justice globally. Utatuzi Center is a proud graduate of the 2020 Kyiv LEPP program. Interestingly, the idea of ADR Week and Legal Aid was incubated during the program.
