We do not need enemies...
I have come to know today that some of the youngones, the post 2007 DRTTAs have filed a case for admission to the LDCE examination. I must congratulate them for having belief in the legal system in India and I wish they held the same faith in their 30% issue too. I appreciate their courage and a different view point altogether. They are a courageous lot and they do deserve a pat on their backs for their inclination towards the struggle for existence. Thank you guys for such an inspirational activity. I think I should learn to struggle too.
Look, I am 49 plus and by default have some apprehensions. Even When I look at my elder son, aged 24, crosses the street, I keep checking whether he could make it and keep worrying as long he made it. I could never look at him as a grown up and probably your parents would agree to what I am trying to say.
Also, I have learnt few things from people like Abhilash Vijayaraj V, Maneesh K Parameswaran, Bandhan Preet Singh Rajesh Sekharan and few other think tanks of SNATTA who have made me to know what I am supposed to know as a DRTTA. That actually puts me into the "APPREHENSION" that I mentioned about in the previous paragraph.
Before speaking about it, I would like to say that, this post of mine, will be little longer than as usual and please bear with me. I request you to read every letter that is punched in by me as I mean them from the core of my heart and I feel the young ones to understand the same. This is my request to you all to read it through before jumping to any conclusion. Thanks and I wish to start it, at where I left.
I am given to understand from few people, few good friends of mine, that a case has been filed by an young one (or) a group of young ones for seeking the eligibility to LDCE that is going to happen on 02 June 2013. (I assure you that I am not sure about it but I wish it came true from the core of my heart). It is what I said in the first para. I congratulate the young folk who did it.
On the other hand, I have a series of probable things that are going to happen after this court case by our dear young ones. I thought I would share it with you all...
(1) The case gets filed (or) is already filed to allow post 2007 to take the LDCE. A good news. We, the ESM, could not do it till date. I wish you all the best.
(2) Similar such cases are going to be filed (or) already filed across the country. Again good.
(3) The young men get provisional admission to the LDCE, the dream of every DRTTA. Congratulations. So far so good.
(4) The court directs the Circle head (or) someone who is supposed to answer these legal queries to file a reply. The reply in general would be like this "Sir/Madam (depends what is the gender of the judge), the matter that is in front of the courts of law is a matter relating to Recruitment Rules framed by the corporate office of BSNL and the respondents in this case should be none other than the CO. Then, there will be an invitation by the courts of law to the CO seeking clarification in this regard and the CO will take its own time to attend the hearing.
(5) In the mean time the LDCE happens (the young ones are happy that they are a part of the LDCE. Again Congratulations. I wish them all the best again.
(6) The CO, the new entrant to this case, would request the courts of law to move the case to the principal CAT as there are similar cases pending at different CATs. The Hon'ble judge will then agree to it gracefully as it is a matter of entire BSNL and not a circle in particular.
(7) The fist laggard, would then happen. The process of moving all such similar cases to the P Cat would take few months and by then your young friends would start asking you the progress of the court proceedings. You would have almost started to feel the heat. It is ok. Since you are young and enthusiastic, you would take this easily and move ahead.
(8) The P Cat would then start it all over again. The judge may be on leave and or your lawyer, whom you are funding from your pocket or from your well wishers could not make it to court or some other form of delay would then come up.
(9) In the first hearing you might be surprised to see that the court withholds your result and allow the other results to be published. You would not like it or the process for the first time. No problems. You still have the energy.
(10) Then the SAGA of "Tariq Pe Tariq" will start. In the mean time your friends, who did not join you in this struggle and could not take the exam, would force the matter of reducing the service condition to 5 or 4 years and the management would say "The case is sub-judicial and no decision in this regard will be made. It is then that all the atrocities will start.
(11) You will start getting calls from all your friends from morning to late night asking you to either withdraw the case or do something. You may start wondering why did you start it in the first instance.
(12) By now, you must have spent a lot of money on lawyers, (as it was from a group of people close to you), you would start struggling for the finances of the case too.
(13) After few months, the case will come to hearing and you will surprised to know that the court will not move a stone against RR and that breaks your heart.
By then you would have successfully achieved the following things:-
(a) SNATTA plans to achieve 4 or 5 years eligibility condition immediately after the examination of LDCE and that would get postponed by atleast 3 years (I think so) and it would be 2015 before you hear the verdict of the courts of law. Unfortunately, like me and many others, the DRTTAs of 2007 who could have taken the LDCE in 2013 (after achieving the 5 years condition) would be delayed by 2 more years and you will have many friends to question you on this blunder.
(b) You would have successfully split the post 2007 DRTTAs into two or more groups of people just fighting with each other for all these issues.
Are you sure You want to be a part of this DRAMA? My request and a
dvice to the young ones is not to buy the story of these few post 2007 DRTTAs showing you the dreams of the future. Do not fall for these guys. I think some union is behind polluting the young minds with the figures. If any such union or person approaches you, just put one single question....."WHY DID YOU NOT TELL ME ALL THIS BEFORE 17th APRIL" and say "NO, THANKS".
The young ones, please do remember and trust me.... it is just your tribe that can feel your pain and no other B_____D. Please have trust in CHQ. We may have some issues like lack of communication or some mis-understainding on issues related to support to unions. But then, it is your home and it is your family. Do not go against it. And you will loose your identity if you do so.
(With a request to the think tanks of SNATTA to correct this post in case of any errors or wrong information. But then, finally, appeal, request the young ones, to with draw if any such case is made as it is not going to yield any result. Please do understand that we can not challenge the RR. If your lawyer is luring you into getting the moon, please do not believe him. Consult CHQ and only then take your action.
Please do not spoil the future of your own post 2007 DRTTAs by filing such weak cases. They will not yield you anything but put you in to all sorts of trouble like arranging the finance and running around the courts and finally hearing a verdict that is very UNPLEASANT to your good self.
Trust the CHQ, as it considers what is good and bad for us. Best Wishes. Thanks for reading this lengthy post.
