📢 Hong Kong Privacy Commissioner Issues New Guidance on Agentic AI and Personal Data Privacy
As organisations explore the productivity potential of agentic AI, privacy governance must remain a core priority.
The Office of the Privacy Commissioner for Personal Data (PCPD) has published new guidance on protecting personal data privacy when deploying agentic AI. Unlike conventional AI chatbots, agentic AI can operate with a higher degree of autonomy and carry out multi-step tasks such as processing emails, making reservations, and handling payments.
The guidance outlines nine practical recommendations for organisations, including:
- Apply data-minimisation principles and limit system access
- Be transparent about how agentic AI handles personal data
- Maintain data accuracy through safeguards and human review
- Set clear retention periods and remove unnecessary data
- Prevent data from being used for new purposes without consent
- Implement strong security controls, least-privilege access, safeguards, logs, and audit trails
- Enable data-access and correction rights
- Conduct ongoing risk assessments and use human oversight for high-impact decisions
- Establish clear governance, accountability, and staff training
The key message is clear: responsible adoption is not just about deploying capable AI agents. It requires privacy-by-design, robust security, transparent data practices, and meaningful human control.
The PCPD guidance also includes a practical security checklist covering the assessment, preparation, deployment, use, and decommissioning stages of agentic AI systems.
