USCIS just restored officers' discretion to deny an application outright — without asking for missing evidence first — if a filing doesn't establish eligibility at the time it's submitted. This isn't a proposal. It's already in effect, and it applies to pending applications too, not just new ones.

→ This is a PROPOSAL under discussion inside the Department of Homeland Security — not a law, not a published rule. No final decision has been made.
→ A nearly identical $100,000 fee was already introduced for H-1B work visas in 2025 — a federal court struck it down in June 2026.
→ There isn't even a formal OPT rule on DHS's own 2026 regulatory agenda. The earliest date on record for one is February 2027.
