In practice, privacy complaints are often just the sharp end of a broader customer experience problem.

I attended the Privacy Awareness Week panel, “Building Trust and Loyalty through Better Privacy Complaint Handling” (Wednesday, 6 May 2026).

Office of the Australian Information Commissioner Carly Kind noted that access requests (requests for personal information) are a significant source of privacy complaints, either directly or as add-ons to other disputes.

From a marketing perspective, access requests often touch campaign history, tracking data, preference changes, segmentation logic, lead source, and identity resolution.

1. Opt-in language that sets expectations
2. Preferences that actually work
3. An unsubscribe that’s immediate
4. A clear “why you’re receiving this” line
5. A complaint path that doesn’t rely on forwarding emails around

If you’re doing a check-in, start with those fundamentals. They’re the difference between “we take privacy seriously” and customers actually feeling it.

Friction doesn’t reduce complaints; it changes where they go.

If customers can’t find a clear path to help, they’ll:

a. Hit “mark as spam”
b. Vent publicly
c. Escalate to regulators

A complaint-ready email programme makes the path obvious:

1. A monitored reply-to
2. A visible privacy contact route
3. A fast acknowledgement with a timeframe

It’s better for customers and better for deliverability.

“Transparency beats legalese”

When privacy-related messaging shows up in email, the goal isn’t to “cover yourself”. It’s to keep trust.

A simple pattern we use:

1. What’s changing
2. Why it’s changing
3. What it means for the reader
4. What choices do they have

That last part is key: agency reduces complaints.

1. Visibility (how many, what types)
2. Consistency (who owns it, how fast)
3. Evidence (what happened, when)

Email marketers don’t need to become compliance officers — but we can advocate for a simple operational backbone: complaints become cases, with categories and owners.

That’s how you protect trust and protect the team from heroics.

“The ‘Why am I receiving this?’ test”

A surprising email is a complaint waiting to happen.

We recommend adding an accurate, plain-English line to every email: “You’re receiving this because you opted in on [date / event / form].”

It sounds small, but it reduces uncertainty, lowers spam complaints, and makes your programme feel transparent.

Bonus: it forces internal honesty. If you can’t write that line truthfully, you’ve found a risk worth fixing.

When the only control you offer is “unsubscribe”, you force people into extremes.

In our experience, a strong preference centre reduces complaints because it gives customers agency:

1. Topics (what)
2. Frequency (how often)
3. Pause options (take a break)

It’s not just UX. It’s deliverability, trust, and fewer escalations.
