The website closed on 1st July 2024 due to The Va**ng Reforms Bill.

I’m unable to answer any emails, as people continue to send requests for help, I can’t help anymore. The government is very strict on this.

I met amazing people and I’m grateful for the opportunity, I was given, to grow and become a successful entrepreneur.

Sadly, despite thousands of hours of work destroyed, practically 1/3 of my life investing and crafting the online shop, TheCoilMan is closed forever. If it wasn’t for all, my dream wouldn’t have been realised. Despite closure, the memories were worth the ride.

A recent research paper going in depth about the harms of Australia’s ni****ne va**ng product policy, is helpful in terms of projected estimated smoking, youth and va**ng rates, through to year 2080 (based on current information from countries worldwide.

It describes in great statistical detail, that the new va**ng bans will delay Australia’s target of >5% smokers by 2030, with current data suggesting that smoking in Australia will be 7.5% by 2080, supported by data and numerous sources. This is directly due to restricting va**ng products.

I have included a URL to this excellent, yet data-heavy, medical journal publication, at the bottom of this Facebook post.

“The results of our modeling suggest that relaxing NVP access restrictions in Australia are likely to yield a net public health benefit. The estimated number of averted deaths because of the relaxed policy is sensitive to assumptions about the presumed relative risks of NVP use compared to smoking and estimates of switching from ci******es to NVPs. Another modeling study also found likely public health benefits from reducing NVP restrictions in New Zealand, while other modeling studies also indicate that NVPs are likely to increase public health. Indeed, since NVP use became more widespread in the United States and England, smoking prevalence has substantially declined, particularly among young adults, while during the same years smoking prevalence showed only modest change in Australia. In New Zealand, a decline in adult path-month smoking prevalence from 11.9% in 2019/2020 to 9.4% in 2020/2021 coincided with an increase in adult daily va**ng prevalence from 3.5% to 6.2%.

In our baseline Permissive Scenario, male smoking prevalence fell from 16% in 2017 to 11% by 2026 (a 13% drop relative to the baseline scenario) and to 2.2% (a 71% relative drop) by 2080. In terms of meeting the Australian government’s goal of lesser than 5% adult smoking prevalence by 2030, smoking prevalence is projected to reach 5% for males in 2042 and for females in 2036, indicating that additional policies will be needed to reach less than 5% by 2030. In the Restricted NVP Scenario, smoking prevalence is 7.5% in 2080 for males and the 5% goal is only reached in 2064 for females. The impact of permissive NVP policies compares favorably to the impact of other to***co control policies. For example, based on recent elasticity estimates, a tax increase equal to about 65% of the current cigarette price (including previous taxes) would be needed to obtain a short-run reduction in smoking prevalence of 12%, which would increase to 24% over the long-run. Nevertheless, with Australian prices as high as AUD 48.70 per pack of 25 ci******es in 2020, the effects of such an increase are highly uncertain and the political acceptability of such an increase is questionable.”

V**E REGULATIONS 2024

Feeling uncertain about the 2024 v**e laws and regulations? You’re not alone. We’re also navigating through some unclear aspects of the proposed regulations, but here’s what I know so far.

This post aims to provide you with the latest information on the 2024 v**e regulations, along with articles for more details.

We strive to keep you updated. If you’ve subscribed to my email list, I’ll notify you of any major changes to the store.

UNCHANGED REGULATIONS
These regulations will remain the same:

- You must be at least 18 to purchase any v**e product.
- A prescription is required to buy ni****ne va**ng products.
- Selling pre-filled disposable v**es with ni****ne is illegal in Australia except through pharmacies.

V**E REGULATION CHANGES
The proposed 2024 va**ng regulations, introduced in late 2023, include the following changes (as I understand them).

FROM JANUARY 1:
- Ban on importing disposable v**es (pre-filled and single-use). Individuals cannot import disposable v**es, but businesses can if they hold a license and permit from the Office of Drug Control (ODC).
- We can continue selling ni****ne-free disposable v**es we have in stock after January 1, but cannot import more. These v**es are always ni****ne-free; safety reports are available upon request.
- All doctors or nurse practitioners can now prescribe ni****ne va**ng products without needing approval from the Therapeutic Goods Administration (TGA). It's at their discretion to provide these prescriptions.

FROM MARCH 1:
- Ban on importing all v**e products, including e-liquid (with or without ni****ne) and hardware, by individuals, even with a prescription. Businesses will need a license and permit from ODC to import and must notify TGA of each product's compliance with their standards (see the current list of notified v**es).
- V**e stores can continue selling the ni****ne-free va**ng products they have in stock after March 1, but cannot import more without the necessary license/permit and TGA notification. It's uncertain how long this will be allowed.
- Imported v**e products from March 1 must meet new device and e-liquid standards and only be sold in pharmacies with a prescription.
- All v**e products will be classified as therapeutic products for smoking cessation or ni****ne dependence management (formerly classified as smoke products under the same laws as ci******es).
- The personal importation scheme will end, prohibiting individuals from ordering ni****ne or ni****ne v**e products from overseas, even with a prescription.
- New device and e-liquid standards set by TGA.
- Limits on flavours to mint, menthol, and to***co for v**e products imported after March 1.
- Existing v**e businesses wishing to stay in the industry will need an import license and permit to supply pharmacies.

AFTER MARCH 1:
The Therapeutic Goods and Other Legislation Amendment (Va**ng Reforms) Bill 2024, introduced to parliament on March 21 by the Minister for Health and Aged Care, needs to pass through Parliament to enforce the following:

- Retail v**e sales ban starting July 1, prohibiting to***conists, v**e stores, and convenience stores from selling non-therapeutic v**es.
- Ban on importing, manufacturing, supplying, and commercially possessing disposable, single-use v**es and non-therapeutic v**es. If the bill passes, illegal v**e manufacturers and suppliers could face fines up to $2.2 million and seven years of jail time.
- Additional penalties for importing, manufacturing, supplying, advertising, or possessing va**ng products contrary to regulations/law, including fines and prison time.
- If this bill passes through Parliament, v**e stores will have to close to the public from July 1.

BILL PROGRESS
The Va**ng Reforms Bill was debated in Parliament on March 27, with many Ministers expressing support or opposition. The bill was referred to a Senate Committee of Inquiry to determine if Australia should proceed with the proposed bill and prescription-only model or move towards regulating v**es like ci******es.

The committee received around 300 public submissions and held two public hearings, calling witnesses from those who submitted feedback.

The Senate Inquiry Report was published on May 8:

- The majority recommended passing the bill.
- National Party Senators published a 'Dissenting Report,' opposing the bill and recommending regulation similar to to***co products.
- The bill must now be voted on by Senators in the June parliamentary sessions.
- Dr. Colin Mendelsohn's recent blog post detailed each politcal party's positions on the bill and the next steps that will determine its future. The National party opposes it, the greens wish to amend it, some independents will vote against it and the labor party supports the bill. (Summarising his opinion: it's currently about 50/50 in support or opposition of the Reforms Bill. Also stating he is cautiously optimistic. This may be determined by political back door deals and then if not, the greens will likely decide the result).

14. Protective Terms
The Agreement protects the users, owner, employees, law enforcement, parliamentary employees, regulatory organisations, health organisations, border force and customs, the TGA, the general public and is primary purpose is to ensure compliance with all parties. Please remember that we are pivoting our business model to primarily coils and pods which are not specified in the legislation. To cut through the legal jargon, we're in agreeance with the new laws, support them, promote the action taken against youth usage/uptake and based on our private encrypted user data, we conclusively can attest to our products being used only by adults for the usage of smoking cessation (up-keep & maintenance). TheCoilMan is in the process of moving on, to other safer industries, so our closure could occur at any time. In this case, all customer's will still be supported, have their orders shipped and as a last resort, immediate refund will be issued.

These are new times for the va**ng industry. TheCoilMan is legally protecting and pioneering an adaption to the new laws, that has occurred. In the event of any law enforcement activity,

TheCoilMan relies on both our limited liabilities and professional indemnity clauses, of both the business and the law firm that professionally and contractually certified these contractual terms as being 100% legally compliant, universally protective and allow operations to flow with no risk. Should these terms falter in any shape or term, we rely and our agreement is for us to amicably sue the law firm, who will cover our legal costs via their own insurance. Hence, voiding the effectiveness of any legal intervention. Furthermore our legal positioning in relationship to therapeutic v**e accessories required for maintenance of legal prescription v**es, omits us from any ties to the new legislation. We are setting the standard for the new age of va**ng in Australia and accept no responsibility for those who try to clone or copy our legal positioning.

Ultimately, we want to help smoker's quit ci******es. Clinical data continues to show ni****ne is useful in a broad range of mental illnesses. We support those through the regulations framework, with Schedule 4 ni****ne and therapeutic v**es being sold only via the pharmacy. These patients have been deemed suitable for va**ng via their Doctor. While we know va**ng is not risk-free, the product we sell are completely risk free. As we do not sell the e-liquids or v**e devices, our hands are free of any risk passed down to the consumer. We remain compliant to the highest quality products which are certified under European & United States regulations, including child-proof certifications. These safety certificates are available upon request and can be accessed by visiting the manufacturer's webpage. We refuse to sell anything illegal or potentially causing harm.

We are waiting for the introductory deadline of the 2024 ban on supply of v**es to run down our stocks of v**es and e-liquids. Once the deadline is set, we cease to sell these products are revert back to our business model detailed above which is highly compliant and highly important for public health and smoking cessation.

Hello TheCoilMan Customers!

Firstly, we want to thank everyone for bringing feedback regarding the past 6 months of a situation to our attention. We understand your concerns and appreciate the opportunity to address them.

At TheCoilMan, we take pride in selling replacement parts for v**es and by helping our customers achieve a better quality of life through quitting smoking (and also saving money!). Therefore, hearing your feedback is crucial to us.

After reviewing the comments and concerns shared here, we want to clarify the initial complaint of the lack of refunds and inform you about the steps we've taken to resolve the issue and improve the situation.

We're committed to ensuring positive outcomes or resolutions, and your feedback plays a key role in helping us achieve this. We're here to listen and make things right. For anyone directly affected by our business negatively, please reach out to us via our contact form on the website, so we can address your concerns personally.

In regards to the late refunds and stocktake issues, we've reported to the Australian Cyber Security Centre (ASD's ACSC) & Australian Cyber Security Centre (ReportCyber). This is due to un-authorised log in to the website and altering of the inventory levels of our business. We have changed passwords, added layers of 2FA and swapped out key log-in details to prevent this from happening. We are working in collaboration to fix this issue that is affecting customers, the business and myself.

Also of transparent value, is the fact that we decided to run a "pre-order" program for approximately 10 months. This was supposed to work by customers placing an order with an allocated pre-order delivery timeline provided, labels pre-generated and pre-orders shipped as soon as they arrived with us from suppliers. We shut down the program completely approximately 4 weeks ago and refunded every customer still in wait for products. We recognised the program as a failure and customer's were left waiting for extended timelines at some occasions, while others were fulfilled within the allocated timeframe. Nonetheless, it was a trial and it failed, the customer's and business suffered because of it and we apologise sincerely for our mistake and the failure.

While we are here, we should mention, we have been in operation for approximately 8 years and in total we have received 30 bank disputes. 25 of those have come within the past 6 months. These are settled either via the banks, the customer or the payment provider. The trail of these started as customer's recommended the tactic on social media. We apologise profusely however we never explained why the lapse in operations occurred after a flawless 7.5 years.

It was never something I imagined I would disclose publicly, however in light of customer's leaking my address, full name, identity, threatening me and my safety and accusing me of scamming... I will disclose it today.

Firstly, please understand that after a negative comment is lodged, whether the outcome falls in the customers favour or not, the feedback almost always survives and is never edited. We have begun reaching out to customers to change this.

I personally over the past 3.5 years developed a mental health issue. It meant that I was hospitalised approximately on 8 occasions with 6 being mandatory (I couldn't leave). The medical condition was gently diagnosed as a low grade psychotic spectrum disorder, alongside my own ADHD and insomnia. I would experience episodes and wouldn't be able to ship or reply to emails for sometimes up to two weeks. I would be locked away in a mental health ward, unable to access my laptop or leave the facility. As soon as I was released, I would race home and fulfil the orders and tap into the emails as best as I could.

It should have been a time for rest and recovery but I worked hard to get those orders out and the emails answered.

What really hurt the most, was the community and how they threatened me, abused my business and began spreading content such as a reddit post. I was called a scammer, I read many very concerning and deceitful comments online and after losing my own sanity and being in hospital, I was doing my best to cope.

On the upside, after 3.5 years of the condition (I could have chosen to go on a disability pension and take the easy route), I battled through it, I never felt I could disclose it as who would want to do business with someone with a condition making them unreliable.

However, working closely with Doctors, I was able to find a medication that works well for me. I have controlled the symptoms/episodes and now I am picking up the pieces of the puzzle and putting them together once more.

I realise there is a lot of uncertainty in the industry at the moment, many are quick to jump towards expressions of hate or that the market conditions are perfect to scam people. Let me reiterate this - I do not need to scam customers. I can think of one customer who never received a refund due to constant abuse. I do agree, refunds at times were late, often inventory isn't correct and we have a situation to deal with due to the above reasons.

I'll wrap this up by saying, of course, when building something for nearly a decade from scratch, it stresses me out seeing the laws change and all that billions of funding for the border, the advertisements and the TGA. Yet all of my fellow business owners who own and operate v**e shops will be getting nothing at all. It is them who will suffer the most, unfortunately. The customers will be able to access ni****ne and therapeutic v**es from the pharmacy but the business owners and my colleagues are not going to be compensated one bit unless they took out some really darn good insurance.

Yes, it's an uncertain time, however when I receive an email saying they will slander me all over the internet and leak all my private information, I've got to remind myself that this is the 0.00001% of customers. It's not reflective of the hundreds of orders we pump out each week.

I apologise for the failed pre-order program, the faulty stock levels and slow email replies. Anything out of stock we refund immediately.

However, based on my own standards, I've failed myself, the business and the customers. It hurts a lot. I really do care about TheCoilMan, no matter what happens, I'm committed to the highest standards possible until the very end.

Due to the v**e import ban in Australia, TheCoilMan is no longer stocking therapeutic and/or non-therapeutic v**es anymore. Based on the 21st of March bill introduction by Mark Butler, the legislative aims are clear and have been targetted. V**es are no longer legal to supply in Australia. Zero mention in any capacity has been provided to coils or pods for therapeutic v**es. It is the customer's responsibility to ensure they are compliant with their general practitioner's advice on smoking cessation. TheCoilMan assumes the banning of supply and importation of v**es means the end of our shop selling v**es at all. When dates are released for the end of supply, we will take down all products containing v**es in order to compliantly abide with the legality of the new va**ng legislations. We collaborate with lawyers to ensure we remain compliant through our compassionate service of providing the essential replacement parts for prescribed therapeutic v**es and updated terms and conditions will be implemented to protect the consumer, ourselves and to support clarity for state law enforcement activities. This undertaking is done for the best interests of those who are improving their healthcare via GP advice for smoking cessation. We will add more comprehensive protection and information as the new bill dates are released. Despite all of this, should legal advice recommend our business to be of legal risk or breach enforceable laws under grounds that are of serious nature, we of course will close our doors for good. We anticipate a response which targets black market dealers, with small scale, law abiding, creative business models built on strong foundations of assisting with smoking cessation being neglected in response to the more serious disposable kid targetting, money and profit hungry operations which do more harm than good. More information is set to unfold, but this is our early stance in order to provide good warning on behalf of our business stance currently that will inform customers, law enforcement, regulatory bodies and (hopfully) ethic committees including risk evaluation and compliance.
