On Labour Courts - rulings and decisions:

In CWU we know it too well that what you have not won in the streets, you cannot win at the boardroom table.

Today a judge in his ruling labelled us as "Confrontational and Obstructionist" for challenging an ongoing jobs bloodbath in Telkom that had led to over 10 000 jobs being lost in just over two years. "Therefore Telkom followed and engaged fairly on retrenchments and it had to be applauded for their openness". On the contrarily bra Sipho Pityana argued that we must not labelled judges as counter revolutionary maybe I'm compelled to agree with him. This is again followed by today's earlier process where circumstances compelled us to withdraw the case against MTN on outsourcing base on the prospects of urgency, NOT the content (heads of arguments).

In many circumstances and even lead to some very controversial inconsistency of the Labour Court rulings, where elites workers predominantly whites and led by the likes of Solidariteit Union wins most of the times if not all of the times.

The question arise in who's class interest are these statutory institutions represents? Are processes of CCMA and Labour Courts really in favour of the poor workers today? I doubt. All the poor workers whom are dismissed and having strong case have gone through humiliating processes of cases being dragged for years without any form of income by powerful and huge profit making companies.

Clearly workers has been sold a dummy since the dawn of Democracy, the LRA that we praise so much is not really the best document we have after all. We need to reflect and revisit our position as workers to crystallise and define the way forward. Without doubt if nothing done or change in terms of our modus operandi, Business will Govern the country. The stubborn and ever gap growing gap between the poor and the rich will continue to expand.

"We should despair because the weather is bad, no do we triumph because there's sunshine"

To: CWU Members

My fellow Comrades - revolutionary and fraternal green to all of you.

Telkom management led by the tyrant Sipho Maseko is at it again. Today our members who're on strike received an unwelcomed text messages (sms) that reads as followed:

Subject:50th Percentile Alignment

Dear Employee;

You are hereby notified that your 50th percengtile alignment letter has been loaded on the SAP Portal for you to view.

Regards

Total Remuneration and Performance Management.

This is a similar approach that Maseko took earlier on in June; whilst we were still discussions with the company he implemented part of areas in discussions namely (a) bonuses (b) moratorium on Retrenchments. The tyrant did so with an intention to appear as a friend of workers or a hero of some sort to workers. In a process he intended to discredit a trade union movement, and make it redundant for workers to see no reasons to associate with a union.

This lousy attempt is a clear indication that the strike action makes rumbling sounds echoing in the corridors of the Telkom's ivory towers. Therefore the myopic management of Telkom thought that issues that were touched at CCMA during negotiations which includes but not limited to (a) 50 percentile backdated to April (b) and the no work no pay, they should pick one to entice workers. Therefore opportunistic the tyrant exploit this space thinking that workers are KIDS, will cheer and go back to work. This is a mere ploy to distract us from our main project of, (1) 11% Salary increases (2) 6 months fully paid maternity leave (3) a 3 years moratorium on Retrenchments (4) Status qou on Gainsharing (5) Bridge the the Apartheid wage gab.

And indeed such a project cannot be attain easily nor can we defend our rights through a smile, at the hands of a brutal white monopoly capital, will stop at nothing to onslaught workers in defence of profit and crass materialism. Ours is continue with our revolutionary yet difficult task to continue with the strike. We must mobilise, agitate and unify workers for a maximum disruption of productivity through legal and peaceful means.

The little that we have attain now i.e. 50 percentile, 2 years moratorium on Retrenchments and bonus paid in June it was through sweat and toils of CWU no any other.

We salute all our members who're on strike for their selfless and dedication and more so as true revolutionaries and foot soldiers of the working class.

Telkom:

Comrades, Sipho Maseko has shown total arrogance to the workers, he is not even guilty of showing this arrogance by refusing to give us increase or putting OP1 over 50th percentile.

He has not shied away from the 12 million of shares for himself and Ian Russell while forcing field workers to give up theirs.

We call on all CWU members, non members and other union members to stay away from working as the pressure is now felt by telkom and we would like to meet each and every member or leader in Parow on Friday.

Remember, we as workers have nothing to loose except our chains. We know that in a short term we will loose a days worth of salary but in a long term we see our children living like Sipho Masekos children. So let us unite for a better tomorrow. Amandla...

It is with great pride to announce that CWU has signed an agreement with DOCEX. This is a victory as Bifawu has not signed while they are a minority union.

Summary:

We concluded on Docex negotiations, what was achieved is for 2015/16 the offer is 2,5% for 8mnths once off and for 2016/17 ofeer is 6,5 pensionable agreement will sustain for 9mnths hence we achieved to change the circle to april from July, that means workers benefit again for the 4mnths as they are going to get their salary earlier, indeed i cwu iyaqhuba amandla.

Telkom:

We note with great suspence on the pressure that Telkom is feeling, we urge all those that have decided to go back to work to minimise the work to the maximum. It has been noted that Telkom offers unlimited overtime and has sent people from other provinces to help out on neighboring provinces, we shall deal with this manner with full attendance.

Trudon:

We have noted the concern of the members in Cape town and we would like to lift our fists to the negotiators who managed to settle the negotiations with success. Aluta continua.

More infor on SENTECH and other companies might be sent via the new page, the "official CWU western cape".

Unity is everything. Aluta continua.
