eLab Insights for Public Defenders: How to Copy Video Digital Evidence.

If you need to make a copy of video digital evidence you received you must follow SWDGE's standards and Best Practices.

First thing you should do when receiving the video is to take picture of the device it is on, then you should baseline the device and get information like make and model of the device. After that you need to obtain the manual of the device to know how to access it.

Using the manual access the device and verify the date and time of the device and check the default frame rate. Output the video as an .AVI file format as a quick copy.

Use the device player to output the video file in the same framerate and the native resolution so all of those settings match the original and include the player.

Make sure to document every step taken and establish a chain of custody.

eLab Forensics – Mobile Device Unlock & Data Recovery

When critical digital evidence is locked behind a damaged, disabled, or password-protected mobile device, the entire case can stall.
That’s where eLab Digital Forensics steps in.

🔓 Mobile Device Unlock & Advanced Data Recovery

Our lab specializes in extracting high-value digital evidence—even when traditional tools fail:

• Screen-locked or disabled devices
• Damaged phones (cracked, no-power, liquid exposure, board-level issues)
• Broken charging ports or battery failures
• Potential deleted data recovery depending on length of time (messages, photos, app data, logs)
• Chip-level access & forensic data extraction
• Secure chain of custody & court-ready documentation

Whether it’s for criminal defense, post-conviction relief, insurance litigation, or civil disputes, our team combines certified forensic examiners with board-level microsoldering specialists to recover the evidence that matters most.

Why it Matters

Digital evidence can verify alibis, disprove claims, validate timelines, and uncover details that change case outcomes.
If a device is inaccessible, that evidence might as well not exist.
We fix that.

Why Digital Evidence Won’t Wait—and How Mishandling Costs Cases

At eLab Forensics, we repeatedly see cases where crucial mobile data, cell site provider records, or video footage existed—but was overlooked or lost because defense teams didn’t act quickly enough. Delay can mean missing the evidence that could change everything.

⚠️ Digital evidence is time-sensitive.

App data expires. Cloud tokens lapse. Providers delete logs on a rolling basis. And if your request doesn’t use the right language or forensic terms? You may never get what you actually need.

✅ The good news?

Best practices and standards for defense teams do exist—and we’ve made them available in the eLab Toolbox.

Whether you're reviewing phone data, requesting records, or assessing a Cellebrite UFED report, our toolbox gives you the practical, defensible steps to take—right now.

🧰 Don’t guess. Don’t wait.

Use the eLab Toolbox to guide your next digital review the right way—before the data disappears.

A Roadmap to Freedom—Built for the Digital Age

As co-founders of Digital Innocence, our team at eLab Forensics helped create the first post-conviction digital evidence review criteria—because when technology evolves, the fight for justice must evolve with it.

Too many wrongful convictions remain untouched—not because the person isn't innocent, but because critical digital evidence was never considered, misunderstood, or inaccessible at the time of trial.

That’s why we built a framework designed specifically for public defenders and post-conviction teams to:

🔍 Re-examine flawed or outdated digital forensics

📱 Recover overlooked or misinterpreted mobile data

🧰 Apply current, hands-on solutions to surface new exculpatory evidence
Here’s something most defenders don’t realize:

🚨 The NDCAC—a law enforcement-only hub—has historical cell data and records keys, from as far back as approximately 2012, that could provide missing data may hold key location evidence that proves innocence.

This isn’t just a second look. It’s a second chance.

👉 We’re here to bring new technical pathways to truth—where none existed before.

eLab Insights for Public Defenders: Unreliable Video Evidence Example

Need to make a copy or received a copy of video surveillance? Per SWGDE, video must be copied with the exact same frame rate as the original. Any copy that alters the frame rate becomes unreliable and may not meet forensic standards because there could be missing frames that have digital evidence in those frames that aren't in the lower frame rate version. The best way to make sure any copied video is reliably done and admissible per standards and best practices, get an expert.

The Defense Never Rests — Neither Should Your Digital Evidence Strategy

This Memorial Day, we honor those who served and sacrificed for our country. Their dedication reminds us that justice requires vigilance and timely action.

Although our office may be closed for the holiday, the defense never rests—and neither should your digital evidence strategy. For public defenders, digital evidence is time-sensitive: phones, apps, video, and other records can be lost or altered in hours. Early action is critical to protect your clients and prevent wrongful convictions.

At eLab Digital Forensics, we provide 24/7 nationwide support for public defenders:
• Preserve time-sensitive digital evidence
• Rapid forensic review
• Defense-driven case strategy
• Prevent wrongful convictions

The defense never rests. Neither should your evidence strategy.

Act now. Protect the record. Free the innocent.

eLab Insights for Public Defenders: Example of Unreliable Evidence

What you need to look out for when you have digital evidence is if metadata has been changed. Whether it is intentionally or accidentally, the evidence becomes unreliable. Metadata is essential for validating authenticity and must remain intact. Make sure to get an expert involved when dealing with digital evidence.
