Have you heard of the OAIC (Office of the Australian Information Commissioner)? They are actively auditing businesses and issuing heavy infringement notices for non-compliance.

1. The Health Provider Reclassification: Martial Arts Clubs, Gyms, and Wellness Centres are now classified as "Health Service Providers" because they collect sensitive health data (medical clearances, injury reports, etc.). Crucial Note: This means the standard $3M turnover exemption for small businesses no longer applies. You are exposed with no threshold.
2. Immediate Fines: Initial infringement notices start at $3,960 for individuals and $19,800 for companies (scaling up to $66k+). If a business tries to cover up non-compliance or misses deadlines, compounding fines apply and further legal defence costs.
3. High-Risk Business Structures: Clubs operating as Sole Traders or Partnerships are the most vulnerable, putting personal assets directly at risk. Operating under a Company and Trust structure offers much better protection.
4. Active Website Audits: The OAIC is actively auditing businesses right now. They are starting with low-hanging fruit: websites that have no privacy policy, or use an outdated one. This alone is triggering significant compliance audits, and the defense costs to challenge them are massive.
